Terms of Service

1. Acceptance of terms
By accessing or using the Oosh platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Oosh reserves the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
2. Description of service
Oosh is a software platform that enables users to create and participate in rotating savings circles, commonly known as tandas, susus, or similar community savings arrangements. Oosh facilitates coordination, recordkeeping, and payment tracking among circle members. Oosh is not a bank, financial institution, money transmitter, or investment adviser. Oosh does not hold, transmit, or guarantee any funds on behalf of users.
3. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent that you are of legal age and have the legal capacity to enter into binding agreements. The Service is available only to individuals, not to companies or other legal entities acting as circle participants. You must provide accurate, complete, and current registration information.
4. Account registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Oosh immediately of any unauthorized use of your account. Oosh is not liable for any loss or damage arising from your failure to safeguard your credentials. Oosh may suspend or terminate accounts that violate these Terms or that appear to be fraudulent.
5. Financial terms
Oosh charges no platform fees to create or participate in savings circles. Users are responsible for ensuring that all financial contributions to their circle are made in accordance with the agreed terms of that circle. Oosh does not guarantee the collection of funds from any member. Disputes between circle members regarding missed or late payments are the responsibility of the members and their organizer. Oosh is not a party to any financial arrangement between circle members.
6. Prohibited conduct
You agree not to use the Service to: (a) engage in fraudulent, deceptive, or illegal activities; (b) collect money under false pretenses; (c) harass, threaten, or harm other users; (d) impersonate any person or entity; (e) circumvent or interfere with any security or authentication features; (f) scrape, crawl, or data-mine the Service; or (g) violate any applicable law or regulation, including anti-money-laundering and know-your-customer requirements.
7. Intellectual property
The Oosh name, logo, and all related content are the exclusive property of Oosh and its licensors. You may not reproduce, distribute, or create derivative works without prior written permission. You retain ownership of any content you submit through the Service, but grant Oosh a limited license to store and display that content as necessary to operate the Service.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. RONDA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. RONDA MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE SERVICE FOR ANY PARTICULAR PURPOSE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RONDA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS, OR DATA LOSS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL RONDA'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO RONDA IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. Termination
Oosh may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue in effect, including ownership provisions, warranty disclaimers, and limitations of liability.
11. Governing law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
